FBI CHANNELING AGREEMENT
Fulcrum Biometrics — FBI Channeling Sub-Contractor
Fulcrum Biometrics will manage the process of submitting fingerprints to the FBI-CJIS to obtain information required for background criminal history checks for its clients. Fulcrum employs the services of TRP Associates LLC (an FBI-approved channeler) who directly submits fingerprints for noncriminal justice purposes and obtains the results of the fingerprint search. All customers must have a current FBI Channeling Agreement signed and on file with Fulcrum Biometrics.
TERMS:
- SUBMISSIONS: Fulcrum will assist the customer in correctly setting up electronic communications with the channeler. The customer will then submit fingerprint information collected by FbF® LiveScan directly to the channeler.
- FEES AND PAYMENT STRUCTURE. The FEES that are collected cover the FBI fee and the FBI Channeling fee. Fulcrum is required to remit payment to the FBI Channeler for customer’s channeling fees no later than the 15th of each month. Fulcrum will receive monthly reports from the channeler. Fulcrum, in turn, will then notify the customer during the first week of each month of any charges that need to be remitted. Fees are based on the volume of submissions per month. The fee schedule for standard DOCE and NFUF types of transactions are as follows:

The FBI Channeling Transaction fees are subject to change with 30-day notification based upon FBI and FBI Channeler pricing changes.
Note: If a fingerprint record is rejected due to image quality and the Customer conducts a proper resubmission of the second record, there will only be one transmission fee charged for the two records that were submitted. A properly resubmitted record must be a cloned record with new prints and include the original TCN and E# placed in the appropriate fields in the livescan record. If the resubmitted record was not cloned and did not include the original TCN and E# in the appropriate fields, you will be billed for two records at the rate of $38/record transmitted. Please review your training materials which cover the resubmission process.
Failure to make timely payments to Fulcrum may result in Account Suspension, especially if this occurs repeatedly. Payments that fail to process correctly or bounce back for any reason result in costs incurred by Fulcrum and increased administrative overhead costs which we will pass on directly to you, with penalties.

- PAYMENT COLLECTION: Payment is made to Fulcrum Biometrics securely through a third-party payment processor. Customer must be set up on autopay. Government agencies may establish an alternative method of payment approved by Fulcrum Biometrics.
- Customers will be invoiced during the second week of the month.
- Payment will be withdrawn ten days after the invoice date.
- Payments rejected for insufficient funds or payments not collected by the end of each month may result in the temporary suspension of a customer’s FBI Channeling account until payment is made. If a customer’s account is suspended for cause, the customer must pay the reinstatement fee in addition to paying all outstanding invoices in full before channeling will be reinstated. There is no guarantee that the FBI Channeler will be able to reinstate your account on the same day your bill is paid. Repeated delinquent payments and suspensions will result in permanent deactivation of your FBI Channeling account.
- Payment via credit card is subject to a 3% service fee and no fee if paid via ACH through our pay invoice link.
- If ACH is selected as the method of payment and payment fails or bounces for any reason, the customer will be charged a Failed/Bounced Payment fee (see table above). After a third bounce or failed payment, a customer will be required to set up a credit card for auto payments. There will be a 3% processing fee associated with credit card payments.
- Customer must ensure that their billing contact information (name, email, and phone) is always current to avoid penalty fees and suspension of services. Changes to contact information must be submitted to orders@fulcrumbiometrics.com.
- SECURITY. The customer must manage logical security (e.g., appropriate and approved access to the software and computer system, safe password practices, appropriate internet firewalls, etc.) and the physical security of the computer (e.g., safeguards against theft of the device) on which FbF LiveScan operates. Fulcrum Biometrics shall not be held responsible for loss, damage, or any civil or criminal actions resulting from unauthorized access or failure to properly protect the computer. Customer must also become familiar with the latest version of the CJIS Security Policy. Annual training is required.
- ACCEPTABLE USE. The Customer understands and agrees that submissions through the FBI Channeling program are limited to individuals who are eligible for processing under applicable FBI Channeling requirements, including U.S. citizens and eligible lawful permanent residents, as applicable. FBI criminal history results must be accessed or retrieved only by the individual who was fingerprinted or by that individual's authorized attorney. The Customer (livescan operators, employees, agents, or representatives) must not access, retrieve, receive, download, or otherwise take possession of an applicant's FBI criminal history results on the applicant's behalf. Unauthorized access to or retrieval of an applicant's FBI criminal history results may constitute a security breach or other reportable security incident and may be subject to reporting to the FBI. The Customer is responsible for ensuring that all personnel who use the FBI Channeling service understand and comply with these requirements.
- LIMITATIONS TO LIABILITY. Fulcrum shall not be held responsible (including for lost revenues) for errors due to a) Any line or power outages or internet down time or interruption or related problems or circumstances by the Customer, including but not limited to any and all information, records, or documentation which is reported as having been received, but which in fact is lost, rejected, or disparaged in any form, shape or manner; b) The content of information assembled by the customer that contains any mistake or maligned, affected, or inaccurate formatting or data; or c) The transmission or reception of fingerprint quality or for any and all records and documents which may be rejected by FBI-CJIS due to poor image quality.
- INDEMNIFICATION REGARDING PERSONALLY INDENTIFIABLE INFORMATION (PII). Customer agrees to immediately report to Fulcrum any: loss of control, compromise, unauthorized disclosure, unauthorized acquisition, unauthorized access, or any situation where persons other than the authorized users, and for other than authorized purposes, have access or potential access to any Personally Identifiable Information (“PII”) (For purposes of this agreement, “PII” shall be defined as information that can be used to distinguish or trace an individual’s identity, such as name, social security number, or biometric records, alone or combined with other personal or identifying information that is linked or linkable to a specific individual, such as date and place of birth or mother’s maiden name]. Customer agrees and represents that it shall indemnify and hold Fulcrum harmless for any action, threat, or proceeding that rises or may arise due to a breach of PII collection by Customer and/or its employees and agents.
- INDEMNIFICATION REGARDING REGULATORY COMPLIANCE. Fulcrum Biometrics warrants that its FbF LiveScan solution is FBI compliant with FBI, EBTS, and Appendix F and technically able to perform the task for which it is sold. Customer is responsible for the correct use of the product regarding submission and compliance to the regulations, obligations, laws, or processes of the agency or agencies to which live scan results are sent. Customer indemnifies and holds Fulcrum harmless for any action, threat, or proceeding that may rise because of Customer’s misapplication or misuse of the product or results produced by this product.
- MODIFICATIONS. Fulcrum may alter or revise the terms of this Agreement by giving Customer thirty (30) days’ notice of the changes to be made. Changes will be posted on Fulcrum Biometrics’ HelpDesk located at support.fulcrumbiometrics.com. The updated FBI Channeling Agreement will supersede any prior agreement. If Customer does not agree to accept the changes, Customer’s sole remedy shall be to discontinue Customer’s use of the Software.
- TERMINATION. Either party may terminate this Agreement on thirty (30) days’ prior written notice to the other. If either party terminates this Agreement, Customer is liable for payment of all unpaid fees due for all fingerprint submissions to FBI-CJIS.
